PRAYER IN AS(MD) No.269 of 2021:

To set aside the Judgment and Decree dated 21.04.2021 made in

O.S.No.43 of 2014 on the file of the Additional District Judge,

Pudukottai.

ORDER : This petition coming up for orders on this day, upon

perusing the petition and the affidavit filed in support thereof and

upon hearing the arguments of M/S.J.ANANDKUMAR, Advocate for the

petitioner and of M/S.S.PRABHA, Advocate on behalf of the Respondent

Nos.1 & 2, the court made the following order:-

This Civil Miscellaneous Petition is filed seeking interim

injunction, restraining the respondents from alienating or

encumbering the suit property pending disposal of appeal suit.

2.The suit has been filed for the reliefs of declaration and

recovery of possession along with damages for future prospects. The

suit was dismissed by the trial Court. Hence, the plaintiff has

preferred the Appeal Suit. Pending Appeal, the appellant/plaintiff

has filed this petition, restraining the respondents from

alienating the suit property. If the respondents encumber or

alienates the suit property that will create third parties interest

and create multiplicity of proceedings.

3.Hence, it is appropriate for the petitioner/appellant to seek

the relief of temporary injunction to restrain the respondents from

alienating the suit property, during the pendency
