PRAYER :-

This Second Appeal is filed under Section 100 of the Civil Procedure

Code, against the decree and judgment passed by the Principal Subordinate

Judge, Dindigul made in A.S.No.99 of 1999, dated 31.12.2003, confirming

the decree and judgment, dated 19.01.1998 passed in O.S.No.40 of 1993 on

the file of the District Munsif, Nilakottai.

JUDGMENT

The learned counsel for the appellant filed an affidavit dated

23.01.2023 stating that the dispute between the parties was settled amicably

and hence, the Second Appeal may be dismissed as withdrawn.

2.In view of an affidavit filed by the learned counsel for the appellant,

this Second Appeal is dismissed as withdrawn. No costs. Consequently

connected Miscellaneous Petition is closed.
