This Appeal has been preferred by the plaintiff against the Judgment

dated 11.05.2011, decree dated 21.05.2011, passed and signed by learned Sub-

Judge-VII, Jamshedpur in connection with Title Suit No. 84 of 2006 whereby the

suit as against the defendant no. 1 decreed ex-parte and against defendant no. 2

on contest.

The case of the plaintiff in brief is that he entered into an agreement

on 09.07.2004 to purchase a piece of land, area measuring 14 ft. x 56 ft., together

with kutcha house consisting thereon under Plot No. 317 (A) and (B) recorded

under Khata No. 413, Survey Ward No. 4, Mouza – Jugsalai, .S. - Jugsalai, District

– Singhbhum East more described in Schedule-A for a valuable consideration of
