The lawyers have no objection with regard to the proceeding,
which has been held through Video Conferencing today at 02.15 p.m. They
have no complaint in respect to the audio and video clarity and quality.
Petitioners are praying for grant of bail as they are in custody for
allegedly committing offence punishable under Sections 147, 148, 149, 341,
323, 324, 307, 504, 506, 427 of the Indian Penal Code and Sections 3/4 of the
Prevention of Witch (Daain) Practices Act, in connection with Barhi Police
Station Case No.424 of 2021, pending in the Court of the Judicial Magistrate,
Hazaribagh.
Heard learned counsel for the petitioners and the learned A.P.P.
for the State and have also gone through the impugned order.
Defects, pointed out by the Office, are ignored for the present.
There is an allegation that several persons including these
petitioners, armed with weapons came to the house of the informant and
threatened the informant and also assaulted him.
From the impugned order and the materials on record, it is
apparent that it is Balram Pandey, who has assaulted the informant with
pharsa.
Learned A.P.P. appearing for the State opposes the prayer for
bail. He submits that the petitioners were members of mob, but, admitted that
main allegation is against Balram Pandey.
Considering the nature of allegation against the petitioner, which
is general in nature, I am inclined to grant bail to the petitioners. Petitioners,
namely, Sunny Ram @ Sunny Kumar and Satish Pandey @ Satish Kumar, are

directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees
Ten Thousand) each with two sureties of the like amount each to the
satisfaction of the Judicial Magistrate, Hazaribagh in connection with Barhi
Police Station Case No.424 of 2021.
