The matter was taken up in National Lok Adalat in virtual mode.
The instant contempt case has been filed against the opposite parties
for alleged, willful and deliberate non-compliance of the order dated
06.08.2019 passed in W.P.(S) No.1846 of 2018.
Mr. Deepak Kr. Dubey, learned counsel for the opposite parties
submits that although the show cause has been filed but as per the instruction,
decision has been taken by the competent authority.
He further submits that since Mr. Arvind Kumar Singh, Under
Secretary to the Directorate Primary Education is present in the Court
proceeding through virtual mode, as such, he may also assist this Court in the
matter.
Upon this, Mr. Arvind Kumar Singh, Under Secretary to the
Directorate Primary Education has submitted that whatever has been said by
the learned counsel for the opposite party about the decision having been
taken by the competent authority with respect to the consideration of cases of
promotion of one or the other teachers has already been taken vide Memo
No.619 dated 26.08.2021.
In terms thereof, there is no difficulty now in taking decision with
respect to the claim of the petitione, therefore, the matter may be disposed
of.
Upon this, Mr. Rahul Kumar, learned counsel for the petitioner
submits that appropriate order may be passed.
This Court, after considering the aforesaid submission and in the light
of the decision taken by the authority as under Memo No.619 dated
26.08.2021, deems it fit and proper to dispose of the matter with the direction
upon the District Superintendent of Education, Gumla to take decision in the
light of the decision contained in Memo No.619 dated 26.08.2021 within a
period of eight weeks from the date of receipt of copy of the order.
In view thereof, the instant contempt case is finally closed,
accordingly, disposed of.
Office is directed to keep the Memo No.619 dated 26.08.2021, sent
through e-mail, on record.
