Heard the parties through video conferencing.

Learned counsel for the petitioner personally undertakes to

remove the defects as pointed out by the stamp reporter within two

weeks after the lockdown period is over.

In view of the personal undertaking of the learned counsel for

the petitioner, the defects pointed out by the stamp reporter are

ignored for the present.

The petitioner has been made accused in connection with

Sahibganj (T) P.S. Case No.59 of 2020 registered under Sections

364/120(B)/34/302/201 of the Indian Penal Code and Section 27 of

the Arms Act.

Learned counsel for the petitioner submits that the allegation

against the petitioner is that the petitioner in criminal conspiracy with

the co-accused persons have committed the murder of the son of the

informant after his abduction and caused disappearance of the

evidence of murder. It is submitted that the allegations against the

petitioner are false. It is then submitted that petitioners have been

implicated in this case only on the basis of confessional statement of

the co-accused Kundan Yadav. It is also submitted that the deceased

was murdered because of having illicit relationship with the wife of

the co-accused-Maltu Mandal. It is then submitted that the petitioner

undertakes that he will co-operate with the trial of the case. It is next

submitted that the petitioners have been in custody since 07.05.2020

as mentioned in para-12 of the instant bail application. It is lastly

submitted that the co-accused persons namely Sonu Yadav has been

admitted to bail by a coordinate Bench of this Court vide order dated

07.09.2020 in B.A. Nos. 5620 of 2020 and Prem Lal Mandal have

already been admitted to bail by this Court vide order dated

03.12.2020 in B.A. Nos. 5084 of 2020. Hence it is submitted that the

petitioner be released on bail.

Considering the facts of this case, the above named petitioner are

directed to be enlarged on bail on furnishing bail bond of Rs.25,000/-

(Rupees twenty five thousand) with two sureties of the like amount

each to the satisfaction of learned Chief Judicial Magistrate, Sahibganj

in connection with Sahibganj (T) P.S. Case No.59 of 2020 with the

condition that they will co-operate with the trial of the case.
