Counsel for the petitioner prays for time.

After going through the record, I do not feel it proper to keep this matter

pending.

The petitioner, who is an accused for the offence punishable under

Sections 302/34 IPC, and Section 3 and 4 of Prevention of Witch (Daain) Practices

Act, is praying for grant of regular bail as he is in custody since 26.10.2021.

Heard the learned counsel for the parties and I have gone through the entire

record including the impugned order.

From record, I find that admittedly there is no eye witness to the occurrence.

Further similarly situated co-accused person has been granted bail by the co-

ordinate bench of this Court in B.A. No. 2664 of 2021.

Petitioner in this case is arrayed as an accused on the basis of suspicion as

it is alleged that one Ashok Prajapati and this petitioner had threatened Hari

Prajapati (the deceased) at some point of time.

Considering the fact that there is no eye witness to the said occurrence and

co accused Ashok Prajapati has been granted bail by the co-ordinate bench of this

Court, I am inclined to allow this application. Accordingly, the petitioner above

named is directed to be released on bail on furnishing bail bond of Rs. 10,000/-

(Rupees Ten Thousand) with two sureties of the like amount each to the

satisfaction of learned Judicial Magistrate, 1st Class, Palamau at Daltonganj in

connection with Lesliganj Police Station Case No. 165 of 2020, corresponding to

G.R. No. 163 of 2021.
