the petitioner and Mr. S.K. Deo, learned A.P.P. for the State

assisted by Mr. Din Dayal Saha, learned counsel for the

informant.

In this application, the petitioner has challenged that part

of the order dated 04.02.2017 passed by learned A.C.J.M.,

Rajmahal in SC/ST P.S. Case No. 03 of 2016 whereby and

whereunder the application preferred by the petitioner for

recalling of the order by which proclamation u/s 82 Cr.P.C. has

been issued has been rejected.

It appears that since the petitioner had not appeared in

the criminal case instituted against him non-bailable
