The present application has been preferred under Section 389 of

the Code of Criminal Procedure for suspending the sentence by original

accused No.7 of the Sessions Trial No.103 of 1999 who is appellant No.1

of the Criminal Appeal.

2)

We have perused the record and proceedings of Sessions Trial

No.103 of 1999 and heard the counsel for both the sides.

3)

Having heard learned counsel for both the sides and perusing the

record and proceedings of the trial Court, there is prima facie case

against this appellant-accused. As the Criminal Appeal is pending, we are

not much analyzing the evidences on record, but, suffice it will be for us to

say that the case of the prosecution is based upon several eyewitnesses
