In this appeal, the appellant herein i.e National Insurance Company Ltd.

has challenged the judgment and award dated 22.7.2014 passed by District Judge-

V-cum-Presiding Officer, Motor Accident Claims Tribunal, Dhanbad, in T.M.V

No. 75 of 2003.

The sole ground taken, on the fact of this case, is that the right of recovery

should have been granted to the appellant.

No. WGB 4204 was insured by this appellant but the owner of the said vehicle did
