Defects pointed-out by the Office are hereby ignored for

the present. However, learned counsel for the petitioner is directed to do

needful within two weeks to remove the defects.

Heard learned counsel for the petitioner and learned

counsel for the State.

Petitioner is an accused in a case registered under Sections

307/34 of the Indian Penal Code and Section 27 of the Arms Act, in

connection with Baliapur P.S. Case No. 138/ 2020, pending in the Court

of learned J.M. 1^st Class, Dhanbad.

Learned counsel appearing for the petitioner submits that

there is no specific allegation against the petitioner and nothing

incriminating articles have been recovered from the possession of the

petitioner. Learned counsel further submits that petitioner has voluntarily

surrendered and as such, there is no chance of absconding or tempering

with the evidence. Learned counsel further argues that petitioner is in

judicial custody since 26.02.2021.

On the other hand, learned APP vehemently opposes the

prayer for bail of the petitioner.

Regard being had to the aforesaid facts and considering the

period of custody of the petitioner, the petitioner, above named, is

directed to be released on bail on furnishing bail bond of Rs. 20,000/-

(Twenty Thousand only) with two sureties of the like amount each to the

satisfaction of learned J.M. 1^st Class, Dhanbad, in connection with

Baliapur P.S. Case No. 138/ 2020.
