Heard learned counsel for the petitioners and learned counsel for the

State.

The petitioners have prayed for grant of bail in connection with

Lalmatiya P.S. Case No.92 of 2017 corresponding to G.R. No.1672 of 2017

registered under Section 302/34 of the I.P.C.

Learned counsel for the petitioners has submitted that the petitioners are

not named in the First Information Report. It is further submitted that the

statement of eyewitness recorded in paragraph 39 does not make out any case

under Section 302 of the I.P.C., as there is no mens rea on the part of the

petitioners. It is also submitted that petitioner nos.1 and 3 ar
