Heard learned counsel for the parties.

The appellant-petitioner was a contractual appointee in the

Department of State of Government. The petitioner applied for the

post of Junior Engineer in response to the Advertisement No. 27 of

2012 dated 31.03.2012, whereunder it has been provided that

permanent government employee or a temporary government

employee will be having the benefit of five years age relaxation. The

petitioner's contention before the learned Single Judge was that the

petitioner, since was employee of the government department,

therefore, under the advertisement, he was entitle to five years age

relaxation. However, learned Single Judge rejected the said
