The instant appeal has been preferred under Section 173 of the

Motor Vehicles Act by the owner of the vehicle against the award of

compensation in Title (Motor Vehicle) Suit No. 11 of 2008 whereby and

whereunder, the learned Tribunal ordered the compensation amount to be

paid by the appellant/defendant no. 1 in view of breach of condition of in-

surance policy.

It is submitted that there was no laches on the part of the owner

of the vehicle as it was having all valid relevant papers and
