This petition has been filed by the petitioners for quashing the order

taking cognizance dated 01.07.2017 for the offence under Sections 341, 323, 325,

326, 504/34 of the Indian Penal Code passed by learned Judicial Magistrate, 1st

Class, Jamshedpur in G.R. No. 3663 of 2015 (Telco P.S. Case No. 521/2015).

Learned counsel Mr. A.K. Sahani for the petitioners submits that so far

as Section 326 IPC is concerned, there is no material on record, which suggests that

this section is applicable in this case. He further submits that the police has submitted

chargesheet under Sections 325 IPC and not under Section 326 IPC and thus the

learned court below should not have taken cognizance for the said offence without

any valid justified ground. He also submits that there is no reasonin
