Heard learned counsel for the parties.

The prayer made in this writ petition is for quashing of the order

dated 29th May,2006 passed by the District Legal Aid Committee,

Dumka, whereby the application for grant of legal aid or exemption from

depositing the court fee stamp amounting Rs.75,700/- in succession

Case No.10/2006 pending in the court of learned District Judge, Dumka

has been refused.

It is submitted on behalf of the petitioner that the said refusal has

been done without proper application of mind, although the annual

income of the petitioner is shown at Rs.15,000/- only. lt is further

submitted that by the impugned order the claim has been disallowed

treating it not to be a matter of court fee for the grant of exemption.
