Two petitioners are apprehending their arrest in

connection with O. C. R Case No. 128 of 2015, registered

under Sections 27(C) and 28(A) of Drugs and Cosmetics

Act, 1940, pending in the Court of Chief Judicial

Magistrate, Jamtara.

The brief facts of the case is that the complainant is

filing this complaint in discharge of his duty as a public

servant and as such his initial statement is not necessary

under Section 200 Cr. P. C. On 16.8.2014, the sample of

Neomet oral suspension B.No.-01, Mfg. date 01/2012, Exp.

date 12/2014, Mfg. By-M/s. New Lab Industry, Ramnagar,

Kurthaul, Patna, was collected from Sadar Hospital,

Jamtara in form-17. The sample was sent for the test to
