Heard learned counsel for the parties.

Petitioner is an accused in a case registered for the offence punishable

under Section 302/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has been

falsely implicated in the present case and has not committed any offence as

alleged in the F.I.R. Though in the fardbeyan of the informant, she while

relying on the information given by the witness Md. Amir, stated that the

petitioner had caught hold of the deceased while co-accused Bickey Quereshi

assaulted the deceased by means of dagger, however the said witness Md.

Amir has already been examined during the trial as P.W. 3 and has not stated

anything against the petitioner in connection with the alleged occurrence,

except the fact that he was
