Heard learned counsel for the petitioner and learned counsel for the

State.

The petitioner is an accused in connection with S.T. Case No.109 of

2020 arising out of Budhai P.S Case No.18 of 2020 for the offence registered

under Sections 147, 148, 149, 341, 323, 324, 325, 427, 452, 307, 120-B, 302

of the Indian Penal Code.

It is submitted that there is general and omnibus allegation against all

the accused persons including this petitioner for assaulting the deceased, due

to which, he died. It is submitted that co-accused person namely, Md.

Nasrullah @ Md. Nasrullah Ansari has been granted bail by the Co-ordinate

Bench of this Court in B.A No.7661 of 2020 vide order dated 03.10.2020. It

is further submitted that co-accuse.d persons namely, Md. Abdullah and Abdul

Kalam Ansari @ Md. Kalam Ansari have already been granted bail by the

Co-ordinate Bench of this Court in B.A No.8698 of 2020 vide order dated

11.11.2020. It is further submitted that co-accused person namely, Abdul

Sattar @ Md. Sattar @ Md. Sattar Ansari has also been granted bail by the

Co-ordinate Bench of this Court in B.A No.141 of 2021 vide order dated

02.02.2021. It is further submitted that co-accused persons namely,

Mohammad Kutubullah & Md. Hasibullah @ Hasib have been granted bail

by the Co-ordinate Bench of this Court in B.A No.6636 of 2021 vide order

dated 28.07.2021. It is further submitted that co-accused person namely,

Rahmattulah @ Md. Rahmattualah has also been granted bail by the Co-

ordinate Bench of this Court in B.A No.8291 of 2021 vide order dated

13.09.2021. It is further submitted that co-accused person namely, Md. Asgar

@ Md. Asgar Ali & Abdul Malik @ Malik Ansari have also been granted bail

by the Co-ordinate Bench of this Court in B.A No.14367 of 2021 vide order

dated 22.12.2021. It is further submitted that co-accused person namely,

Sahida Khatoon @ Puchan Bibi has been granted bail by the Co-ordinate

Bench of this Court in B.A No.11405 of 2021 vide order dated 18.11.2020. It

is further submitted that co-accused persons namely, Md. Abdullah & Abdul

Kalam Ansari @ Md. Kalam Ansari have been granted bail by the Co-ordinate

Bench of this Court in B.A No.8698 of 2020 vide order dated 11.11.2020. It

is further submitted that co-accused person namely, Md. Nousad has been

granted bail by this Court in B.A No.14801 of 2021 vide order dated

07.01.2022. It is submitted that the petitioner is in custody since 21.09.2021

and hence, he may be enlarged on bail.

Learned counsel appearing for the State has opposed the prayer for bail.

Perused the F.I.R, the case diary and the orders passed by the Co-

ordinate Bench of this Court.

It appears that there is general and omnibus allegation against all the

accused persons for assaulting and committing the death of the deceased. It

appears that several accused persons have been granted bail by the Co-

ordinate Bench of this Court and this Court as mentioned above.

Considering the grant of bail to the other accused persons by the Co-

ordinate Bench of this Court, the petitioner, Md. Ikbal @ Md. Ikbal Ansari, is

directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees

Ten Thousand) with two sureties of the like amount each to the satisfaction

of learned Addl. Sessions Judge-VI, Deoghar in connection with S.T. Case

No.109 of 2020 arising out of Budhai P.S
