Heard learned counsel for the parties.

This criminal miscellaneous petition has been filed under Section

482 Cr.P.C. by the petitioner with a prayer for modification of order

dated 29.09.2022 passed in A.B.A. No.6492 of 2022 and for extension of

time.

Learned counsel for the petitioner has submitted that due to

inadvertence, the name of petitioner has been mentioned “Ikbal Singh”

in the cause list of main petition and the same has also been mentioned

in order dated 29.09.2022 passed in A.B.A. No.6492 of 2022, whereas the

original name of petitioner is “Ikbal Singh @ Iqbal Sheikh”, due to

which the petitioner could not surrender before the learned court below

within stipulated time. It is further submitted that the name of

petitioner be read as “Ikbal Singh @ Iqbal Sheikh” in place of “Ikbal

Singh” and time period of surrender before the learned court below be

extended by two weeks. Hence, the said order dated 29.09.2022 passed

in A.B.A. No.6492 of 2022 be modified.

Considering the aforesaid submission of the learned counsel for

the petitioner, prayer for modification of a part of the order dated

29.09.2022 passed in A.B.A. No.6492 of 2022 is allowed and time period

for the petitioner to surrender before the court below in terms of the

order dated 29.09.2022 passed in A.B.A. No.6492 of 2022 be extended by

two weeks from the date of receipt of the copy of this order.

The order dated 29.09.2022 passed in A.B.A. No.6492 of 2022 is

modified to the aforesaid extent. This criminal miscellaneous petition is

disposed off accordingly.
