The lawyers have no objection with regard to the proceeding,

which has been held through Video Conferencing today at 02.15 p.m. They

have no complaint in respect to the audio and video clarity and quality.

Petitioner is praying for grant of bail as he is in custody for

allegedly committing offence punishable under Sections 341, 324, 307, 504,

506/34 of the Indian Penal Code and Sections 3/4 of the Prevention of Witch

(Daain) Practices Act, 2001 in connection with Belbadda Police Station Case

No.57 of 2021, pending in the Court of the Sub Divisional Judicial Magistrate,

Godda.

Heard learned counsel for the petitioner and the learned A.P.P. for

the State and have also gone through the impugned order.

Defects, pointed out by the Office, are ignored for the present.

It has been submitted that the petitioner is the husband of the

informant. It is alleged that the petitioner has married another lady and there

was dispute amongst them. It is alleged that the petitioner has assaulted the

informant. From the impugned order, I find that cognizance has been taken

under Section 307 of the Indian Penal Code and the Sessions Judge I, Godda

has mentioned in the impugned order that injury report suggests the injuries

are simple in nature.

Considering the fact that injuries are simple in nature and

cognizance has already been taken, I am inclined to grant bail to the petitioner.

Petitioner, namely, Jitendra Mahto, is, accordingly, directed to be released on

bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two

sureties of the like amount each to the satisfaction of the Sub Divisional

Judicial Magistrate, Godda in connection with Belbadda Police Station Case

No.57 of 2021, with a condition that the petitioner will not enter the house

where the informant is residing. The Village Pradhan will ensure that this order

is complied with.
