Applicant seeks condonation of 133 days’ delay in filing the appeal.
On perusal of application and after hearing learned counsel for the
applicant, I find a sufficient cause is made out by applicant for condoning.
Accordingly, this application is allowed. Delay of 133 days’ in filing the appeal
is condoned. CONC disposed of.
Appeal be diarized. Appeal, however, is taken on board, given urgency
expressed by learned counsel for appellant.
Notice. Notice in CM as well, to be served upon respondents 1 to 6
through Process Serving Agency of District Judge, Baramulla, and respondent
no. 7 through Process Serving Agency of District Judge, Budgam.
Meantime, subject to depositing of Award amount, execution
proceedings shall remain stayed unless amount already released and paid to
claimants. In case appellant deposits the award amount before the Registrar
Judicial, same shall be kept in FDR, initially for a period of six months, with
the J&K Bank Branch High Court, Srinagar.
List this Appeal for consideration on 04.03.2021.
