This is an application seeking condoning of delay of 01 year & 95 days in

preferring an Appeal against judgement and decree dated 12^th May 2012, passed

by Additional District Judge, Srinagar, in Civil Original Suit no.45.

Learned senior counsel appearing for applicants states that applicants had

no knowledge as to judgement and decree dated 12^th May 2012 and that it was

only in October 2013 that applicant no.2 received a notice from this Court in a

civil revision, being Civil Revision no.57/2013. It is also submission of learned

senior counsel that applicants also came to know that Additional District Judge

cancelled sale deed with respect to immovable property, which had previously

been owned by applicants before its transfer and acquisition by the Government.

Sufficient cause is shown by applicants for condoning the delay.

Accordingly, application is allowed and delay in filing the Appeal is condoned.

COD no.599/2013 disposed of.

Let the appeal be diarized, unless already diarized, and listed on 3^rd June

2022.
