….. Respondent(s)

Through:

Ms. Insha Haroon, GA.

CORAM:

Hon’ble Mr. Justice Sanjay Dhar, Judge.

ORDER

24.08.2022

CRMC No. 300/2018:

Nobody has been appearing in this case on behalf of the petitioner for quite

some time. Same is the position today.

The petitioner has challenged FIR No 114/2018 for offences under

Sections 354 and 341 of RPC registered with Police Station, Baramulla.

Reply to the petition has been filed by the respondents. A perusal of the

reply shows that after the investigation of the case, offences under Section 341 and

354 of RPC stand prima facie established against the accused including the

petitioner herein.

In view of the fact that the allegations in the impugned FIR stands

substantiated by the evidence collected by the investigating agency, this Court

would be reluctant to exercise its powers under Section 482 of the Cr. PC to quash

the proceedings in the impugned FIR. The petition being devoid of merit and is

accordingly dismissed.

CPCR No. 03/2018:

The main petition out of which the interim order that is subject matter of the

instant petition has arisen, stands dismissed, as such, these proceedings do not

survive. The contempt petition is, therefore, dismissed and the proceedings are

dropped.
