Through the medium of instant petition filed under Section 561-A

Cr.P.C., petitioners seek quashing of challan No.171/2011 arising

out of FIR No.129/2011 dated 30.04.2011 registered at Police

Station Domana, Jammu under Section 498-A, 323 & 109 RPC

against them, on the ground of compromise arrived at between

petitioners and respondent No.2.

It is pertinent to mention here that on 03.04.2019 this Court had

directed learned counsel to produce the parties before Registrar

Judicial for recording their statements in order to authenticate the

compromise deed.

Pursuant to the aforesaid direction, Registrar Judicial has recorded

the statements of petitioners and respondent No.2, who have been

identified by their respective counsel. The said statements are

placed on record, which read as under:-

Statement of Amit Gupta (petitioner no.1); Age : 42 years; S/o

Bansi Lal; R/o Barnai, Jammu on oath today i.e. 26.04.2019

Stated that I have entered into a compromise vide compromise

deed executed on 24.08.2018 with respondent no.2 namely Shalini

Gupta and I have amicably settled all disputes and issues with

respondent no.2. I pray Hon’ble Court to allow the petition and

quash the proceedings in FIR No.129/2011 dated 30.04.2011 under

section 498-A, 109, 323 RPC against the petitioners pending before

Learned Electricity Magistrate, Jammu.

Statement of Sunny Gupta (petitioner no.2); Age : 44 years;

S/o Bansi Lal; R/o Barnai, Jammu on oath today i.e. 26.04.2019

Stated that I have entered into a compromise vide compromise

deed executed on 24.08.2018 with respondent no.2 namely

Shalini Gupta and I have amicably settled all disputes and issues

with respondent no.2. I pray Hon’ble Court to allow the petition

and quash the proceedings in FIR No.129/2011 dated 30.04.2011

under section 498-A, 109, 323 RPC against the petitioners pending

before Learned Electricity Magistrate, Jammu.

Statement of Sharda Devi (petitioner no.3); Age : 62 years;

W/o Bansi Lal; R/o Barnai, Jammu on oath today i.e.

26.04.2019

Stated that I have entered into a compromise vide compromise

deed executed on 24.08.2018 with respondent no.2 namely Shalini

Gupta and I have amicably settled all disputes and issues with

respondent no.2. I pray Hon’ble Court to allow the petition and
