In the instant petition, petitioner has sought for the

following reliefs:

(i)

Issue a writ in the nature of certiorari quashing

the impugned Order dated 28-02-2018 passed by the

Respondent No.2 in case No.RP 17/2017, which is

enclosed as Annexure-A

(ii)

Pass such other order or orders as this Hon'ble Court

may

be

pleased

to

pass

in

the

facts

and

circumstances of the case and so as to meet the ends

of justice and equity.

2. Petitioner is the great grandson of late Sowcar

Thimmappa. Deceased Sowcar Thimmappa had participated in

auction of the property of Sy. Nos.38,49,40,41 and 36

respectively as is evident from the sale proclamation dated

02.07.1920. Later on, it seems the survey numbers were

renumbered

(vide

Annexure

N).

Thereafter,

survey

renumbered were entered in the name of deceased Sowcar

Thimmappa were effected in the revenue records. Consequently,

number of proceedings have been drawn like conversion of land

and acquisition. Respondent No.7 filed a complaint before the

Deputy

Commissioner

relating

to

genuiness

of

auction

transaction between deceased Sowcar Thimmappa and the then

State of Mysore. Based on complaint, Deputy Commissioner

proceeded to pass an order on 28.02.2018. Extract of the order
