Petitioner – husband is knocking at the doors of Writ
Court for assailing the maintenance order dated 05.07.2022
passed by the learned Additional Senior Civil Judge at
Madhugiri in his pending divorce petition in M.C No.
43/2020. By the said order passed u/s 24 of Hindu Marriage
Act, 1955, the learned Judge has directed the payment of
monthly maintenance at Rs. 2000 and a lump sum of Rs.
10,000 as litigation expenses.

Having heard the counsel for the petitioner and
having perused the petition papers, this Court declines
indulgence as under:
(a)
The relationship between the parties is not in
dispute and petitioner has sought for dissolution of
marriage in the pending matrimonial case. The learned
Judge of the Court below having considered all aspects of
the matter has made the discretionary order of the kind and
therefore, this Court in its limited supervisory jurisdiction
constitutionally vested under article 227 cannot undertake a

deeper examination thereof vide SADHNA LODH vs.
NATIONAL INSURANCE COMPANY LIMITED (2003) 3 SCC
524.
(b)
What is awarded by way of monthly maintenance
is Rs. 2000, i.e., a frugal sum of less than Rs. 70 per day.
