THIS PETITION COMING ON FOR ‘PRELIMINAY HEARING’
THIS DAY, THE COURT MADE THE FOLLOWING:
ORDER
This petition is filed for a writ in the nature of mandamus
to direct respondent No.3 to conduct survey and fix
boundaries of Survey Nos.89,87, 101 of Gudibande Talulk,
Gudibande.

The learned counsel for the petitioner submitted
that the petitioner is the owner of the aforesaid land and due
to certain disputes between the petitioner and respondent
No.4, the petitioner had filed a representation before the 3rd
respondent on 11.05.2017 requesting them to conduct a
survey and fix the boundaries of the aforesaid land. He
submitted that even after four years, respondent No.4 has
failed to conduct survey and therefore seeks for a direction to
respondent No.3 to conduct survey and fix the boundaries.

The learned Government Advocate submitted that
survey of the aforesaid land shall be taken and the limits of
the properties shall be fixed if adequate time is granted.

In view of the above, the following:-
ORDER
1)
Writ petition is allowed. Respondent No.3 is
directed to conduct a survey and to fix the limits of the
aforesaid land within one month from the date of receipt
of a certified copy of this order.
2)
It is needless to mention that respondent
No.3 shall hear and notify all the concerned adjoining
land owners before conducting the survey and fixing of
boundaries.
