BAIL - SECTION 498A AND 306 OF IPC - SUMMARY
Fact of the Case:
The petitioner was arrested for the offences punishable under Sections 498A and 306 of IPC. The complainant alleged that the petitioner had been torturing his wife on petty issues and had made attempts to murder her by using a pillow. Finding of the Court:
The court found that there were no allegations in the complaint that would prima facie attract the offence under Section 306 of IPC. The court also noted that the post-mortem report showed that the death was due to hanging.
Issues: Whether the petitioner was entitled to bail.
Ratio Decidendi: The court held that the petitioner was entitled to bail as there were no allegations in the complaint that would prima facie attract the offence under Section 306 of IPC. The court also noted that the post-mortem report showed that the death was due to hanging and that the petitioner had no criminal antecedents.
Final Decision: The court allowed the petition and directed the petitioner to be enlarged on bail subject to certain conditions.

hanging. The allegations made in the complaint would not
prima facie attract offence under Section 306 of IPC.
Petitioner who has no criminal antecedents is in custody
from 10.10.2023. Accordingly, prays to allow the petition.

Per contra, the learned HCGP has opposed the
