This writ petition is filed under Articles 226 & 227 of the

Constitution of India, praying to issue writ or order in the nature

of writ of mandamus directing the respondents to consider the

representation of petitioners dated 9/07/2020 vide Annexure-Q;

and issue such other orders or directions as this Hon'ble court

deems fit.

This writ petition coming on for Orders this day the Court

made the following:

ORDER

Petitioner, who was an applicant to the post of Junior

Engineer pursuant to the notification dated 08.09.2016 issued

by the 2nd respondent, has filed this writ petition with a prayer

for a writ of mandamus directing the respondents to consider his

representation dated 09.07.2020, vide Annexure-Q, wherein he

has made a request to publish/issue waiting list.

2.

Learned counsel for respondent Nos.2 & 3 has filed

statement of objections and, in para 3, it has been stated as

follows:

“3. It is submitted that all the vacant posts are re-

notified as backlog vacancies in the year 2019, and the

candidates who were selected and were called for

validation of caste certificate and also have to take the

character report and validation of caste certificate from

the concerned Deputy Commissioner, hence no backlog

post is published in respect of the post which are under

the validation process. Moreover all other posts which are

3

vacant are to be filled up by publishing them as backlog

vacancies in the next recruitment. Therefore, the

contention that other companies have issued waiting list

and the present Respondent ought to have issued waiting

list for the 2015-16 notification has no merit. Under the

facts and circumstances of the case the present writ

petition

is

misconceived

and

the

petitioners

representation vide Annexure-Q is devoid of merits and

liable to be rejected. Therefore, the Writ Petition is liable

to be dismissed.”

3.

Since respondent Nos.2 & 3 have stated on oath that

the selection process is not complete in respect of three posts,

the prayer made in the writ petition cannot be considered as the

same would be premature. Under the circumstances the

petitioner is not entitled for the relief sought for in the writ

petition.

Accordingly, the writ petition is dismissed. However, it is

made clear that the respondents shall complete the process of

selection as expeditiously as possible.
