THIS APPEALS COMING ON FOR ORDERS, THIS DAY,
THE COURT, DELIVERED THE FOLLOWING:
JUDGEMENT
MFA No.20438/2012 is by the claimants seeking
for enhancement.
2.
MFA
No.20096/2012
is
by
he
Insurance
Company challenging the liability.
3.
The
fact
that
an
accident
occurred
on
11.10.2008 when the driver of the Maruthi car
bearing No.KA-23/N-5454 lost control of the vehicle
and as a result the car turned turtle causing grievous
injuries to inmates is not in dispute.
4.
It is also not in dispute that among the inmates
of the car was a 8 year old boy i.e. son of the claimant

he succumbed.
5.

license produced to the Insurance Company indicated

Insurance Company related to a driving license
bearing No.MH/01/96/4937. The Tribunal came to the
conclusion that on the basis of this extract it could not
be held that the driving license (Ex.R2) was fake and
5
it proceeded to saddle the liability on Insurance
Company.
