EXECUTIVE ENGINEER (ELE.) – Appellant
Versus
SMT. PARVATEWWA W/O GOVINDAPPA GADAGI – Respondent


This appeal is filed by the defendant Nos.1 and 2

challenging the judgment and decree dated 19.02.2016

passed by the Principal Senior Civil Judge and CJM, Gadag,

whereby suit has been decreed. The defendant has been

directed to pay a sum of Rs.19,24,000/- with 6% interest.

The case of the plaintiff is that the plaintiff is

the owner of the land bearing Sy. No.237/2 of Dambal

village, Mundargi Taluk measuring 6 acres 19 guntas. It is

further case of the plaintiff that the said land is an

irrigated land, the plaintiff has invested huge amount of

Rs.15,00,000/- by availing the loan from the Bank. The

further case of the plaintiff that the plaintiff has grown

sugarcane on the said land. On 03.02.2011 at about 05:00

p.m. the fire has been broke out from the transformer

installed by the defendant. Due to that fire had caught to

the standing crop of sugarcane in the land belonging to

the plaintiff. The plaintiff suffered loss and claimed

damages of Rs.18,77,500/- for the sugarcane as well as

equipment and reparation.

The further case of the plaintiff that on

05.02.2011, the adjacent property belonging to the

plaintiff’s son had also suffered damages due to catching

of fire
