JAGADISH – Appellant
Versus
THE STATE OF KARNATAKA AND ANR – Respondent


The appellant - accused No.1, who sought to be

prosecuted for the offences punishable under Sections 279,

337, 338, 307, 504 of IPC, and under Section 187 of Indian

Motor Vehicle Act and Sections 3(1)(r)(s), 3(2)(v) of SC/ST

(PA) Act, 1989, is before this Court seeking anticipatory bail, in

the event of his arrest.

Initially, the 2nd respondent had lodged the FIR

alleging that, the accused herein drove the car in a rash and

negligent manner resulting in causing grievous injuries to him.

The FIR was registered for the offences punishable under

Sections 279, 337, 338 and Section 187 of the IMV Act.

Thereafter, in the further statement, the 2nd respondent has

alleged that, the accused with an intention to kill him

deliberately dashed against him and abused him by referring

his caste name. The appellant - accused and the 2nd

respondent are known to each other and the 2nd respondent

having not alleged that he was abused in filthy language by

referring to his caste, the petitioner - accused No.1 has made

out a prima facie case to enlarge him on bail, in the event of

his arrest. Accordingly, I pass the following:

ORDER

Criminal appeals stand allowed.
