The Criminal Appeal No.3625/2012 and Criminal Appeal

No.3618/2012, have been filed by the accused No.2 and 3, being

aggrieved by the Judgment of conviction and order of

sentence dated 07.07.2012 in S.C.No.149/2009 on the file of

the Principal District and Sessions Judge, Bidar, whereby

they have been convicted for the offence under Section 304-I

read with Section 34 of IPC and sentenced to undergo simple

imprisonment for three years and also to fine of Rs.25,000/-

in default, they shall undergo simple imprisonment of 9

months.

The State being aggrieved by the Judgment of

conviction and order of sentence dated 07.07.2012 against

Accused Nos.2 and 3, has preferred Criminal Appeal

No.3503/2013 seeking to set – aside the conviction of

accused Nos.2 and 3 for the offence under Section 304-I

read with Section 34 of IPC and convict them under Section

302 read with Section 34 of IPC.

The Accused No.1, was convicted along with

Accused No.2 and 3 and was sentenced to undergo

imprisonment for life on 07.07.2012 in S.C No. 149/2009.

Being aggrieved by the Judgment of conviction and order of

sentence the accused No.1 filed the appeal along with

accused No.2 and 3 and the same was numbere
