Petition filed under Section 438 Cr.P.C.
2. Petitioner in B.A.No.1763 of 2017 is the first accused and petitioners in B.A.No.2152 of 2017 are accused 3 and 4 in Crime No.2133 of 2016 of Peroorkada Police Station registered for the offence under Section 420 IPC.
3. The first informant is engaged in the business of purchasing gold ornaments pledged with banks after they are redeemed by the borrowers with the money advanced by him. According to the prosecution the petitioner requested him to help her to redeem her ornaments pledged with Pattam branch of the Federal Bank for which she wanted Rs.14,17,000/. The first informant reached the bank with the amount and handed it over to her. She went into the cabin of the manager and came back. The second accused who was with the first accused remitted the amount into the accounts of the third and fourth accused. Immediately thereafter the first accused attempted to escape. She was nabbed by the first informant with the help of others. She promised to discharge the debt, but she failed. Learned counsel for the petitioners submits that the story narrated by the first informant is false.
