J U D G M E N T

The prayers in this Writ Petition (Civil) are as follows:

“(i) To issue a Writ of Certiorari Quashing Exhibit P-8.

(ii) To direct the Respondents not to initiate any action under Section 3B or 3D of the National Highway Act, 1956 against the properties which are not notified by Exhibit P8 under Section

3A of the National Highway Act, 1956.

(iii)To declare that the acquisition steps initiated without adhering to relevant sections of the National Highway Authority Act, 1956 as illegal.

(iv) To declare that the acquisition steps initiated without carrying out the realignment of the property as proposed by the consultant named SMEC as per letter No.NHAI/HQ/Kerala/NH- 17 &47/2015-16/42 dated 27.06.2016 is illegal.

(v) Pass such any other order, direction or reliefs as this Hon'ble Court may deem fit in the interest of justice, equity and good conscience.”

Heard Sri.P.A.Mohammed Shah, learned counsel for the petitioners, Smt.I Sheela Devi, learned Central Government Counsel appearing for R-1 Union Government as well as Standing Counsel for NHAI appearing for respondents 3 & 4 and Smt.A.C.Vidhya, learned Government Pleader appearing for respondents 2, 5, 6 & 7.
