ORDER
1.This application is filed under Section 439 of the Code of Criminal Procedure.
2.The petitioner is the accused in Crime No.1103 of 2017 of the Kattappana Police Station registered alleging offence punishable under section 21(c) of the Narcotic Drugs and Psychotropic Substance Act, 1985.
3.While the police officials attached to the Kattappana Police Station were checking vehicles on 20.8.2017 at Edassery Junction at Kattappana, they intercepted a car bearing registration No.KL-08-AS-7436. Search of the vehicle resulted in the seizure of 17.2Kg of Hashish oil. Except for the driver, who took to his heels, the rest of the accused were arrested.
4.The learned counsel appearing for the petitioner submits BA 7211/2017 2 that he is innocent of the allegations. According to the learned counsel, the petitioner was arrested on 19.8.2017 in connection with some other Crime and he was brutally assaulted. Later, he was implicated as accused in the instant crime. He relies on Annexures-A1 and A2 to buttress his submissions.
5.The learned Public Prosecutor on instructions would submit that investigation has revealed that a total quantity of 116 Kg of Hashish oil was transported to Idukki from
