COMMON ORDER

These Crl.M.Cs arise from Crime Nos.931 of 2012 and

1036 of 2012, both of Pettah Police Station now pending as C.C.Nos.43 of 2013 and 46 of 2013, both of Additional Chief Judicial Magistrate Court, Thiruvananthapuram.

2. The allegation in Crime No.931 of 2012 was that, on

04.09.2012 at about 7 p.m., accused assaulted the son of the defacto complainant. When the defacto complainant intervened, she was also assaulted. Complaint was laid and crime was registered. After investigation, final report was laid for offences punishable under sections 143, 147, 148, 341, 326, 427 r/w 149 of the Indian Penal Code. The allegation in Crime No.1036 of 2012 is that, on 27.09.2012 at 3.30p.m., accused, using a sword caused damage to the bullet vehicle of the defacto complainant and threatened the mother. Pursuant to the complaint laid by the defacto complainant, crime was registered and after investigation, final report was filed for offences punishable under sections 294(b), 447, 506(ii) of the Indian Penal Code and section 27 of the Arms Act.

3. It appears that, sole accused in Crime No.1036 of 2012 is the first accused in Crime No.931 of 2012. Other accused are his family members. The de
