The petitioner is the sole accused in Crime No. 393 of 2011 of

Thirurangadi Police Station for offences punishable under Sections 341

and 323 of IPC. The petitioner is working as Junior Consultant in

Government Taluk Head Quarters Hospital, Thirurangady since 2005.

The second respondent claims to be a dumb came to the hospital on

10.08.2011 while the petitioner was on duty and insisted him to certify

his disability for applying for a free pass in stage carriage. Since the

second respondent failed to produce the disability certificate issued by

the Medical Board, the petitioner expressed his inability to issue the

certificate. The second respondent left the hospital after creating a

commotion. Thereafter, on 12.08.2011, the second respondent filed

Annexure A complaint before the Sub Inspector of Police, Thirurangadi

alleging assault by the petitioner. In the complaint, it is alleged that on

10.08.2011, the second respondent approached the petitioner for

disability certificate and he was required to be present on the next day.
