The revision petitioners are accused Nos.1 to 10 in C.C.No.72 of 1996 on the file of the Judicial First Class Magistrate Court-I, Kochi. They preferred this revision petition challenging the conviction and sentence imposed against them as per judgment dated 8.10.1999 in C.C.No.72 of 1996 of the trial court i..e, the court of Judicial First Class Magistrate-I. Kochi and the judgment of the appellate court dated 30.11.2000 in Crl.A.No.342 of 1999 of the First Additional Sessions Judge, Ernakulam.
2. The allegation against the accused is that Pws.1 and 2 and their parents Pws.4 and 6 were residing in the house of the relative of accused Nos.5 and 6 and as they refused to vacate the house in time, the accused persons, with intention to attack PW1 and his family, themselves formed into an unlawful assembly and criminally trespassed into the premises of the said building at 10 p.m.on :-2-:
31.12.1995 and with the above object, the accused had beaten PW1,2,4 and 6 and thereby committed the offences punishable under Sections 143,147,148,447,448,323,324,326,427 read with Section 149 of I.P.C. With the above allegation, crime No.2/1996 was registered in the Kannamali Police Station. A
