O R D E R

This revision petition is filed by the accused against the conviction in Criminal Appeal No.555 of 2001 of the Sessions Court, Thrissur. They were accused in C.C. No.219 of 1999 before the Judicial First Class Magistrate Court, Kunnamkulam for having committed the offences punishable under Secs.341, 323 and 324 read with Sec.34 of the Indian Penal Code. The charge against the accused is that on 22.02.1999 at 8.00 p.m., they assaulted PW1 at Kadambully bridge while he was returning after seeing the Kapliyangad pooram. The 1st accused caught hold on the collar of his shirt, 2nd accused beat him with a stick, 3rd accused fisted on his head and the 4th accused kicked on his belly. As a result, he sustained serious injuries. Vadakkekad police registered a crime under Secs.341, 323 and 324 read with Sec.34 IPC and after completing investigation, laid charge before the Judicial First Class Magistrate Court, Kunnamkulam. A2 was absconding and his case was split up by that court.

2. During trial, prosecution examined PW1 to PW6 and marked Exts.P1 to P4. MO1 was admitted as material object. The incriminating circumstances brought out in evidence were denied by the accused while quest
