THIS WRIT PETITION (CIVIL) HAVING COME UP FOR ADMISSION ON

08.04.2019, THE COURT ON THE SAME DAY DELIVERED THE FOLLOWING:

This writ petition is filed by the petitioners

seeking the following relief:-

"i

To issue a writ of mandamus or such other

appropriate writ order or direction commanding

the 4th respondent to comply with Exhibit P3

and not to proceed with the Exhibit P1 tender

notification.

ii

To direct the second respondent to take a

decision on Exhibit P2 petition after hearing

the parties within a time limit stipulated by

this Honourable court.

iii

To direct the 4th respondent to remove the last

sentence in condition No 8 Part 2(c) of

Exhibit P1 Tender Notification which reads "If

the Contractor is having ITI/Diploma/BTech or

equivalent qualification, experience in dam

operation is not required".

The subject issue relates to a contract being

proceeded with violating the notice inviting tender.

Today when the matter is taken up, learned

Standing Counsel for the Electricity Board submitted

that the contract was cancelled on 29.03.2019. In the

developed circumstances, learned counsel for the

petitioners submitted that submission may be recorded

and the writ petition may be closed. Accordingly, the

writ petition is disposed of recording the said

submission.
