O R D E R

The petitioner was arrayed as an accused for offences punishable under Section 138 of the Negotiable Instruments Act in CC No.28/2008 on the file of the Judicial First Class Magistrate's Court-II, Ottappalam, instituted on the basis of a complaint made by the first respondent herein. The amount covered by the dishonoured cheque involved in this case is Rs.65,000/-. It is stated that the trial court concerned had convicted the petitioner and had imposed substantive sentence of three months’ simple imprisonment and a compensation of Rs.65,000/- with default sentence clause of three months’ simple imprisonment. This has been confirmed by the appellate court in criminal appeal No.521/2009 on the file of the Sessions Court, Palakkad. In Annexure-A1 order dated 19.7.2011 passed by this Court in Crl.RP No.1754/2011, the conviction has been confirmed; but the substantive sentence of three months’ simple imprisonment has been reduced to one day imprisonment, till the rising of the court, and the compensation amount of Rs.65,000/- with the default sentence clause has been confirmed.
