O R D E R
This revision petition is preferred by the accused against the judgment in Criminal Appeal No.370 of 2003 of the Additional Sessions Judge, Fast Track-II, Palakkad. He was accused in C.C. No.349 of 2000 of the Judicial First Class Magistrate Court, Mannarkkad which was filed under Sec.324 of the Indian Penal Code (for short, IPC). The learned Magistrate convicted the accused and sentenced him to undergo simple imprisonment for six months under Sec.324 IPC. Against that, he preferred the above Criminal Appeal, where the learned Additional Sessions Judge, Fast Track-II, Palakkad dismissed the appeal. Being aggrieved by that, the accused preferred this revision petition.
2. The charge against the accused is that on
26.06.2000 at 7.00 a.m., while PW1 was having tea from a tea shop the accused assaulted him with a chopper. As a result, he sustained serious injuries. Agali Police registered a crime and after completing investigation laid charge in the Judicial First Class Magistrate Court, Mannarkkad. During trial, prosecution examined PW1 to PW7 and marked Exts.P1 to P5. MO1 chopper was admitted as material object. Incriminating circumstances brought out in evidence were denied
