ORDER

The prayer in the aforementioned Criminal Miscellaneous Case filed under Section 482 of Cr.P.C. is as follows:

“...to quash all further proceedings pursuant to Annexure I First Information Report & Final Report in CC No.956/2012 on the files of Judicial First Class Magistrate Court I, Aluva, in Crime No.2795/12 of Aluva Police Station, Ernakulam Rural, in the interest of Justice.”

2. Heard Smt.Vinaya V.Nair, learned counsel appearing for the petitioner (sole accused) and Sri.Santhosh Peter, learned Public Prosecutor appearing for respondent, State of Kerala. Though notice has been duly served on R2, there is no appearance for the said party.

3. The petitioner herein has been arrayed as the sole accused in the instant Calendar Case, CC No.956 of 2012 on the file of the Judicial First Class Magistrate Court-I, Aluva which has arisen on account of the submission of the impugned Annexure I First Information Report and final report in crime No.2795 of 2012 of Aluva Police Station in which the petitioner has been arrayed as the sole accused for the offences punishable under Section 294(b) of the IPC. It is apprised to this Court that in this case so far charges have not been framed by
