COMMON JUDGMENT

Two applications were filed before the District Court, Palakkad, under Order 39 Rule 2A of the Code of Civil Procedure, 1908 (in short, the Code), alleging that the appellants herein have flouted the orders of the trial court, which was confirmed by the above said court in Civil Miscellaneous Appeals (CMAs), and thereby they are liable to be proceeded for dis-obedience of injunction. Respondents 1 to 3 in the proceedings before the District Court are the appellants and the petitioners and 4th respondent are the respondents in these appeals.

2. Heard the learned counsel for the appellants, learned counsel for the contesting respondents and also the learned counsel for the 12th respondent.

3. Short facts:

O.S.No.279 of 2001 was filed before the Munsiff's Court, FAO Nos.185 & 186 of 2013 2 Palakkad for a declaratory and consequential injunction reliefs. I.A.No.1447 of 2001 was filed along the suit, seeking an order against the appellants from removing the contesting respondents, except the 12th respondent, from membership of the Kerala State Small Industries Association, Palakkad.
