ORDER

1.The petitioner is the de facto complainant in C.C.No.83 of

2012 on the file of the Judicial Magistrate of 1st Class-I, Kozhikode. The aforesaid case was instituted against the 1st respondent herein alleging offences punishable under Section 420 of the IPC.

2.The prosecution allegation is that on 22.1.2003, the 1st respondent herein induced the petitioner to give a sum of Rs.2,40,000/- by assuring her that she would arrange a job in the Guruvayoor Devaswom for the grandson of the petitioner. According to the prosecution, the petitioner did not keep up with her promise and failed to arrange the job assured. Stating these allegations, a complaint was filed before the Sub Inspector of Police, Chevayoor, based on which crime was registered and on culmination of the investigation, final report was laid before the jurisdictional court.

3.The prosecution examined as many as 8 witnesses as PWs1 to 8 to prove its case through whom Exts.P1 to P3 were marked. The learned Magistrate on a meticulous evaluation of the entire materials came to the conclusion that the prosecution had failed to bring home the offence alleged and the accused was acquitted under Section 248 (1) of the Code of Crim
