P.N.Ravindran, J.

The appellant is the husband of the first respondent. The second respondent is the appellant's father-in-law. The marriage between the appellant and the first respondent was solemnised on 18.10.1999. Later the parties fell out. The appellant thereupon filed O.P.No.174 of 2009 before the Family Court, Nedumangadu for a declaration that he is the owner of the petition schedule property. The appellant had also prayed for a decree cancelling settlement deed No.1935/2008 of SRO, Palode, which was later produced and marked as Ext.B5. O.P.No.174 of 2009 was tried and disposed of along with O.P.No.189 of 2009, a petition filed by the first respondent for a decree of divorce dissolving the marriage between the parties. By judgment delivered on 24.4.2013, the Family Court, Nedumangadu dismissed O.P.No.174 of 2009. O.P.No.189 of 2009 was allowed and a decree of divorce was passed dissolving the marriage between the parties. The appellant has, aggrieved by the judgment delivered by the Family Court dismissing O.P.No.174 of 2009, filed this appeal. He did not however challenge the decree of divorce passed by the court below.
