J U D G M E N T

The petitioners herein are plaintiffs in O.S.

No.331 of 2015, on the files of Munsiff Court, Changanacherry as well as the petitioners in CMA No.82 of 2015 on the files of the District Court, Kottayam. This Original Petition is filed by the petitioners, seeking a direction to the District Court, to dispose of CMA No.82 of 2015, within a specified time. According to the petitioners, the District Court initially passed Ext.P3 interim order; but it has not been extended thereafter. Taking advantage of that aspect, the respondents are taking preparations to cut and remove trees from the plaint scheduled property and to commit waste in the properties. If the entire trees would be cut and removed, the petitioners will be put into irreparable injury and great financial loss. In the above circumstances, the petitioners have sought for a direction to the Court below, to dispose the CMA No.82 of 2015, within a specified time.

2. Heard the learned counsel for the petitioner and the learned Standing Counsel appearing for the respondents.
