JUDGMENT
Petitioner is a supplier of fabricated goods for the first respondent, which is a Government of Kerala undertaking. According to Ext.P1 e-tender conditions, the first respondent is to make 95% of payments to the petitioner for the goods supplied, within 45 days from the date of acceptance of delivery. According to the petitioner, as per Ext.P5, first respondent had earlier granted the facility of early/immediate payment to the petitioner for the goods supplied as against deduction of appropriate interest. However, now the said system of early payment is withdrawn, on a wrong notion born by the second respondent that e-tender conditions does not permit payment before 45 days. Anyhow, consequent to the situation that is raised by the petitioner, petitioner has submitted Ext.P6, dated 23.01.2018 before the first respondent, which is pending consideration. Even though various reliefs are sought for in the writ petition, learned counsel for the petitioner conceded that if a direction is issued to consider Ext.P6, within a time frame, the other reliefs sought for in the writ petition are not pressed by the petitioner.
